Senior Care Home Negligence


My elderly mother lives in a nursing home. Due to the neglect of the staff she fell and fractured her hip. What can I do?
When we place our loved ones in a home, we do so under the belief that they will receive appropriate care in a safe environment. Unfortunately, this is not always the case. Too often elderly residents of nursing homes suffer harm due to neglect, inadequate supervision, improper restraints, medical error and physical or sexual abuse.
There are currently 1.6 million people aged 65+ in Ontario and this is expected to be the fastest growing age group. The elderly are amongst the most vulnerable in our society so reports of harm should be taken seriously, immediately reported to the home’s administrator and quickly investigated.
There are many situations where a lawsuit can be brought by the injured person and her family members against the nursing home for damages and expenses.  In the unfortunate situation where injuries result in death, a claim can sometimes be made by the deceased’s estate. In the most serious cases, criminal charges may also be warranted.
