Developing land in Ontario
Q: I have purchased real estate in Ontario that I want to develop. Now what?
A: Your first step, and perhaps the most important in the land development process, is to hire a legal advisor. Developing land in Ontario presents a myriad of potential legal issues that require time and money to overcome, and a diligent legal advisor can assist in mitigating the amount of time and money expended throughout the development process.
If you are planning on developing land in order to build new homes or commercial buildings, you will likely need to work with the municipality to negotiate Plans of Subdivision and Site Plan Control Agreements. You may also require minor variances or zoning amendments if your intention with the land you have purchased does not satisfy the original vision of the local land use committee.
As well, and depending on where you have purchased land, you may need to work with owners of surrounding properties in order to solidify access to the parcel through easements or private road agreements, consult with local First nations groups, or obtain and review environmental approvals.
Finally, and in addition to the above listed “macro” problems, you are likely to encounter unanticipated “micro” issues, such as defending municipal bylaw and provincial offence prosecutions or registering, challenging and litigating construction lien matters.
The real estate lawyers at Ross & McBride are ready and able to provide guidance and assistance to you regarding the above noted issues, amongst others.
