Halloween Safety: Can Homeowners Be Liable if a Trick-or-Treater Gets Hurt?
Halloween is meant to be fun, but with dozens of children rushing up walkways in the dark, accidents can happen. What many people don’t realize is that homeowners may be legally responsible if a trick-or-treater is injured on their property!
In Ontario, the Occupiers’ Liability Act requires property owners to keep their premises reasonably safe for visitors including all the little ghosts and superheroes on Halloween night. Hazards such as wet leaves, poor lighting, loose steps, or decorations that block pathways can all create risks that lead to injury. If a child falls because of unsafe conditions, the homeowner could face a personal injury claim.
Fortunately, a few simple steps can reduce the risk. Homeowners should clear leaves and debris, check that outdoor lighting works, secure or reroute extension cords, and keep walkways clear of decorations. Parents can do their part too by choosing costumes that fit properly, adding reflective tape or glow sticks, and sending children out with flashlights.
Halloween is about candy, not claims. By taking precautions, everyone can enjoy the night safely. And if an accident does occur, it’s important to seek medical care and legal advice right away!
