Pool and Water Safety
As a property owner in Ontario, you have a legal obligation to ensure the safety of anyone using or near your swimming pool. Under the Occupiers’ Liability Act, owners and occupiers are required to take reasonable steps to keep their premises safe for all visitors. This responsibility extends to the use and surroundings of your swimming pool.
To reduce the risk of accidents and protect yourself from potential liability, you must:
- Clearly communicate pool safety rules to guests;
- Supervise individuals using the pool, especially children;
- Provide both verbal and written warnings about shallow or deep areas;
- Regularly inspect for and address hazards around the pool.
In the event of an injury or, tragically, a fatality, you could be held liable if it’s found that reasonable precautions were not taken. It is strongly recommended that you speak with your insurance broker to confirm that your homeowner’s policy includes sufficient coverage for pool-related incidents.
Maintaining a safe pool environment is not just a matter of responsibility—it’s a legal requirement. Proactively managing risks helps ensure the safety of your guests and protects you from serious legal consequences.
