Should You Settle Your Car Accident Case or Go to Court?

If you’ve been injured in an accident, one of the biggest decisions you’ll have to face is whether to accept a settlement or take your case to court. The answer isn’t always straightforward because each case is unique.

Many car accident cases are successfully resolved through negotiated settlements.  This saves time, legal costs and stress and is private. A settlement allows you and your lawyer to have a say in the final negotiated agreement. In court, the decision is in the hands of a judge and/or jury and in most cases is a part of the public record.

But there are times and situations when proceeding to a trial in Court is a smarter path. If a settlement offer doesn’t reflect the true value of your injuries, economic losses, long-term care needs and damages, proceeding to a trial may be necessary to secure fair and true compensation. If the at-fault party denies responsibility or if liability is being unfairly shifted to you, a trial may be necessary to prove your case with evidence.

An experienced personal injury lawyer won’t rush you into a quick settlement or drag you through an unnecessary trial. They will guide you through both options helping you understand the pros and cons of each option and ensuring you don’t settle for less than you deserve.
