What to do if your private disability insurance benefits are terminated after a car accident injury

Q: I was injured in a car accident and have been receiving long-term disability benefits through my private disability insurance company. The company has now terminated my disability benefits. What can I do?

A: There are many reasons why your disability benefits may have been denied such as insufficient medical evidence, pre-existing health issues, a lack of objective evidence and unfavourable surveillance. You need to adhere to the strict timelines under your policy for appealing the denial or starting a lawsuit. You should read through your policy to understand the limitations. You should also ensure that your benefits were not denied due to missing or deficient forms. It might be necessary for you to obtain medical records or a medical report from your treatment physicians outlining why you are functionally unable to complete the essential duties of your own job or any other job for which you are qualified.

It is vital that you appeal the denial of your benefits as soon as possible. There are strict timelines for appealing the denial which are outlined in your policy. You should contact an experienced disability lawyer as soon as possible who understands the claims, forms and evidence required to appeal the denial of your benefits effectively.
