Understanding your employment rights in Ontario

Q. I’ve been hearing a lot about employment rights lately, but I’m not clear on what they really mean for me as an employee. Can you explain what key rights I should be aware of?

A. In the ever-evolving landscape of work, understanding your employment rights is crucial. As an employment and human rights lawyer, I’ve witnessed numerous situations where a deeper knowledge of these rights significantly impacted employee outcomes.

In Ontario, while employers can terminate employment for almost any non-discriminatory reason, many employees are unaware of the full extent of their entitlements regarding notice or pay in lieu of notice. Often, this exceeds the minimum outlined in the Employment Standards Act (ESA). If you’ve received an offer below your notice entitlements, this is considered wrongful termination. It’s vital to understand your notice rights thoroughly. If you feel you’ve been shortchanged upon termination, seeking legal advice is a wise step to ensure your rights are upheld.

Discrimination, whether based on gender, race, age, or disability, is intolerable in the workplace. You’re entitled to a work environment free from such practices, encompassing aspects like hiring, promotions, and job assignments. Awareness of these rights is essential for a fair and respectful workplace.

Furthermore, employers must accommodate employees’ disabilities or other needs unless it causes undue hardship. Accommodations may involve adjustments to work schedules, workspace, or equipment provision. Knowing your rights in this area assists in negotiating necessary job adjustments.

Being informed about your rights is the first step towards protecting them. Facing workplace issues? Seeking legal advice offers clarity and direction. As a committed advocate for employment rights, I’m here to help navigate these complexities and safeguard your rights.
